By accessing or using the Exasetu cloud storage platform and related services (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
Exasetu provides a cloud-based file storage, synchronisation, and sharing platform. The Service includes a web-based file manager, desktop sync clients, and related tools for managing files and collaborating with others.
3. Account Registration
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorised use of your account.
- You must be at least 18 years old to create an account.
4. Free and Paid Plans
Exasetu offers free cloud storage upon signup. Paid plans with additional storage and features are available. Details of current plans and pricing are listed on our Pricing page.
- Paid subscriptions are billed monthly or annually as selected at the time of purchase.
- All prices are in Indian Rupees (INR) and include applicable GST.
- You may upgrade or downgrade your plan at any time from your account settings.
- Refunds are provided on a case-by-case basis. Contact support for refund requests.
5. Acceptable Use
You agree not to use the Service to:
- Upload, store, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Infringe upon the intellectual property rights of any third party.
- Distribute malware, viruses, or any other harmful software.
- Attempt to gain unauthorised access to the Service or other users' accounts.
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Resell or redistribute the Service without our written consent.
6. Your Content
- You retain all ownership rights to the files and content you upload to the Service.
- You grant us a limited licence to host, store, and transmit your content solely for the purpose of providing the Service.
- We do not access, scan, analyse, or monetise your files for advertising or any purpose other than providing the Service.
- You are solely responsible for the content you upload and share through the Service.
7. Data Storage and Availability
- We strive to maintain high availability of the Service but do not guarantee uninterrupted access.
- We perform regular backups but recommend that you maintain your own backup copies of important files.
- Storage limits are determined by your plan. Exceeding your storage limit may restrict your ability to upload new files.
8. Intellectual Property
The Service, including its design, logos, interface, and underlying technology, is owned by Exasetu and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
9. Termination
- You may close your account at any time from your account settings or by contacting support.
- We may suspend or terminate your account if you violate these Terms, with or without notice.
- Upon termination, your files will be retained for 30 days to allow you to download them, after which they will be permanently deleted.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Exasetu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
